Defective Pur-Lite 15 Watt CFLs

I thought this picture (below) might be of interest to you. I'm trying to find information on the manufacture of these light bulbs as I fear these lights may be unsafe if left unattended.

I have a bulb that melted in my lamp (see picture below) and the only information I can find is your website that showed pictures of a very similar light bulbs that did the same thing. I have a pur-lite 15 watt bulb with the product code of SUX-070-01 and I cannot find a contact number anywhere. I even called Canadian Tire head office and they couldn't help me.

I found your site while doing a search for this particular bulb after replacement. What I found when I removed this was startling.

This bulb was installed in an open wall mounted sconce type fixture, so there was free air circulation all round the bulb. It was installed in a new building - construction was completed in July 2005, so this lasted for approx. 6 months. The bulbs operated continuously in a public area of my building and I chose this type of bulb to lower the electrical demand. I now have in the order of 90 bulbs to check and/or replace if they are in similar condition to this one. The photos speak for themselves (see picture below).

I have come across your writings recently and would like to share a picture (see below) and comment regarding Pur Lite spirals. I was taking my dog for a walk and noticed the lights in the garage flickering. Upon entering the garage I could smell something electrical burning. The bulb in the garage door opener was actually smouldering and glowing. You can see the result in the picture I have attached. These were purchased at Canadian Tire in Ontario,Canada. I have since removed over 20 of these bulbs from my home. The bulb is a Pur Lite 15w model # SUX-070-01. Somewhat ironic that the first 3 letters of the model # are ''SUX''.

I would like add to you responses on this article. We had replaced our entire house with the CFL's purchased at Canadian Tire a year or so ago. They where the Pur-Lite 15 Watt Spirals SSX-070-00. Since we put them in we have had a problem with these bulbs continuing to flash every 5 minutes or so after being turned off. This continues for 1/2 hour or more. This freaked me out enough but that is not where it ends. We had one of the bulbs burn at the base just as you are showing in your article (see picture below). It was VERY hot and did not cool for quite a while. I feel that had I not been home and found it in time to take appropriate action it would have turned into a very tragic ending. There was a lot of smoke and a very strong smell. Needless to say I have removed them all. Is it possible for you to tell me a brand name and model of one of these bulbs that you would feel comfortable putting in your home. I still want to take advantage of saving energy, but I am highly spectacle.

Here are the pictures of that bulb that caught fire in my socket. You'll notice on picture (see below) the big chunk that flew out of it. I am going to peruse this issue!

I had another CFL's go up in smoke this one was in a open lamp, it was the same brand (Purlite 15 Watt). I thought I had taken them all out, I missed this one, its not hard to find them, they smoke for about a minute and then you can visually find them, the last time I contacted UL, their comment was if I didn't get a shock or there was no actual fire or damage from a fire they really couldn't care less, I also contacted the local fire station, I talked to a fire inspector, he was not concerned at all, only if it had manufactures recall, and if there was a fire to call the fire hall, the last people I contacted was Sask Energy-power they promote energy savings a recommend using CLF's I deleted there e-mail, but it said they are a good energy saver and an odd bad one doesn't out weigh the savings, that's fine if its not his house or family, I find it amazing the lack of concern these government and local services have, how many did this company sell???

I purchased two 4-packs of the Pur-lite 15 watt spiral lamps (Pro-9000X) from Canadian Tire, and was somewhat surprised at the colour temperatures they produced. In the article, you mentioned that your samples had colour temperatures of 2900 & 4000 degrees Kelvin, which is in line with what the manufacturer's description of the light would suggest. However, the lamps I purchased seem to differ from this. The lamps labelled "Soft White Elite" (with the silver base), produce the same cooler colour as all the 4000 to 4100 degree lamps I have. Hardly what one expects from a "Soft White" lamp; I think "Cool White" more accurately describes my samples. The gold base "Brite White Elite" lamp produces a very cool, blue "daylight" look, definitely over 5000 degrees. While I actually prefer the cooler colours in my workshop or utility areas, it wasn't what I expected from the description on the packaging. They will not be used in my normal living areas because the light is very cold in comparison to the 2700 degree and 3000 degree lamps used throughout the house.

I do not have the particulars for the operation of this lamp (hours, location, etc.) because it was given to me by a friend and comes from his parents house. I believe it may come from a ceiling-fan/light-fixture combination in a kitchen. I am a fire investigator and he knew it would be of interest to me. The product details are legible in the photos, which speak for themselves.

I am going to pass on your ongoing article to friends and family and send you the following photos (below) of a Pur-Lite SSX-070-00 (bought at Canadian Tire); which caught on fire in my house. I killed the fire by turning off the light switch; the fire did not trip the circuit in my electrical panel. I then removed the bulb and managed to break a part of the light bulb when it dropped out of my oven mitt (burnt my hand through the glove it was so hot). If I wasn't at home at the time to put out the fire...I assume I would have come home to ashes…SCARY!

Not sure if you are still involved with the CFL safety problem - but we just had one burn out last evening (PurLite 15Watt model SSX-070-00 Pure Natural Soft - White Elite) if we had not been home - it would have resulted in a tragic fire. It was glowing red hot - smoking - was located in an open light fixture - am attaching a picture of same - I have already sent in a complaint to UL - which after reading a note on your site - they probably aren't interested.

The bulb (SSX-070-99 15 watt) was in the stage of burning out, smoke filled the room, the base of the bulb was charred where the swirl meets. Thankful for us to be home at the time, this could and would have caused a fire. Because of this we have discontinued the use. Kelley

Update July 22 2007, for the most part the response has been (overwhelming) but It has been very positive, thank you! I had no idea this page was in public view..

A few of you out there wondered why I would keep wearing the flip flops? That is not what I said, what I said was I wore them here & there for a little while at a time

My feet would be red but I just thought it was because the straps were maybe tight, or they were new, or the first flip flops of the year, I chalked it off to tender feet.

Let me make this perfectly clear, AS SOON AS I REALIZED THERE WAS A PROBLEM I STOPPED WEARING THE SHOES.

In total I wore the shoes maybe 10 to 12 times.

I had to remove this voicemail due to the high volume of traffic we have been receiving

Hi all! For those of you who don't know, I used to work at Walmart for a short time, but quit

Before I quit though I did buy a pair of cheepie flip flops to wear over a weekend trip to the beach, Long Boat Key April 20th to be exact.

I actually got the stupid shoes in Aprill with a picture in mind then in June I wore them a few times

Well, after wearing them my feet would be red and sort of tingly, but I figured that it was just because it was first flip flops of the year so my feet need to get used to them. Blabity blabity... Well I have now had what appears to be a chemical burn for 11 days, (As of July 3rd) I really thought it would just go away on it's own. It is absolutely not going away very well at all...this started on

June 22nd 2007 and has just gotten worse basically. I have only worn those shoes 15 minutes here, half an hour there, hour there...and so on, NOT enough time to burn my feet like this!

I apologize for you having to look at my feet, really..... sorry!

This was taken Monday 7-9-07 around 10 pm, I am in total agony, my toes and left foot is SO swollen!

This should be going away now & here I am in total agony....There is liquid seeping out of these apparent burns, it is so gross.

I took this to show how swollen my feet got, last night(7-09-07 around midnight) was very scary, I really thought I was going to end up in the ER. (The blue color you see is some soothig gel)

I have worked very hard to remove the scabs...I know that is so gross, but it's a fact, anyhow, this is what my feet look like today (Friday) as of 8pm. They still hurt, and I can still only

put on my old beat up tennis shoes, not my tennis shoes that I like, I tried & it about made me cry! But the good news is that this is finally getting so much better! It looks great huh?!

(sad part is, I am actually serious)

I will be updating this page as I need to but I really will keep it updated.

I am wondering just how much this is going to scar? I will be glad when this is over.

7-6-07 Under advisement of my attorney I have boxed up the actual offending flip flops and tucked them away in a safe place.

THE STORY

Like I said I got these stupid shoes for a picture, then ended up wearing the yellow ones and got all these apparent burns on my feet from them.

7/2/07 I tried to alert Walmart to a possible problem so that no little kids might end up with this (it hurts after all!)

The only reason I didn't buy MY OWN son a pair of these is because I thought he would not be able to walk well in them, he is only 3 after all.

I called the home office and nicely explained that I used to be an employee, and I bought the shoes, and I just want to make sure that no kids were hurt...bla bla. IN MY OPINION,The home office

was pretty decent about the entire thing. Then the store in Summerfield called, July 2nd 1:44 pm and left a voicemail, They told me I had to come in. The GM (Richard) told me who to talk with the training manager (Mike Sidel) and

when he would be in. He (Richard) seems to be a nice guy. I went in 15 minutes to a half an hour after getting the voicemail. I thought it was important to go in there.

IN MY OPINION,I couldn't believe how rude and mean, and obnoxious Mike was to me, he acted like I was making it all up, I tried to show him my injuries so he would take it a bit more seriously

& he turned his head away It is my opinion so that he could say he never saw it. Infact, It is my opinion that everyone in the office was acting as if I were the "bad guy" I told him the details and he filled out a report. He asked me,

"well, what do you want me to do about this?" I told him that "if there was infact a problem with the shoes that I wanted to make sure someone knows so this doesn't happen to anyone else" .

He told me "well, nothing will come of this because you bought them in April and you are just now reporting this?"

When I tried to explain the timeline to him he didn't want to listen and turned his back on me so I just quit talking.
I never used to think so but now I really feel like Walmart is a horrible company. You would have to been there but it was almost as if since

I was a former employee, It is my opinion he was going out of his way to try

and be mean to me. I have heard this is a common Walmart practice, but I didn't really believe it til now. Now It is my opinion that is correct.

After he filled out the incident report I had to ask for a copy as he didn't seem to want to give me one. I then took on the stance that I wasn't leaving until I got a copy so he made me a copy.

I limped out of the store and went home, a bit shocked and a lot disgusted.
All I wanted to do was let them know that there might be a problem with some Chinese made shoes since I am not allergic to latex or rubber.

I have always worn rubber flip flops like this and never

had any type of problem. I am not a sue happy type person but automatically he was defensive and basically acted like a complete jerk to me.

So now I have decided to let every single person who will listen know exactly what happened to my feet and how I feel a representative of Walmart acted toward me.

We'll see what happens next.

I spent hours on the phone trying to get a doctor's appointment and finally

7/3/07 I went to the doctor today, it was actually a community clinic where the poor people go, I am fairly poor so this I thought would be fine. After answering several very personal

and inappropriate questions and a five hour wait

she said it was "defiantly from the flip flops"

(but then you'd be hard pressed to think otherwise huh?)

She also said it may scar and gave me some cream that doesn't seem to be doing alot for it.

Anyhow, while I was at the doctors The insurance company for Walmart called and left a voicemail for me (You can play it on the top of the Page)

this is my dog, he has nothing to do with this, but he's cute huh?

She has described the flip flops to a T, the ones that burnt my feet are yellow with pink straps. The very same as she is describing so I am going to try to help this girl to.

7-9-07 9pm I talked with Holly, it is like hearing me tell the story, her situation is nearly identical to mine, she even bought her flip flops right around the same time as me, mid to end of April.

(you have to wonder if it wasn't a bad batch huh?)

I couldn't believe it, her story is the SAME, I posted another question on yahoo answers hoping to find more people that this may have happened to, I know Holly & I aren't the only ones out there.

7/9/07 I spent some more hours on the phone today trying to get another doctor's appointment because my feet are getting worse, It isn't a rash so that stupid cream is not doing anything at all. I have been told no appointment til October, we don't even see people who are uninsured, we are not taking any new patients at this time...I have heard it all today.

But I finally found an urgent care place that is the low low price of $135.00 I felt like I hit the lotto!

So I jumped in the car and went there, and will have her final report later this week, she said that it is a reaction from the flip flops, and she has never seen anything like that. I was given 10 days worth of antibiotics, and a script for steroids which I will have filled tomorrow. My feet are killing me, I am walking on the sides of them because the skin rips open if I try to walk on them like normal. Holly pointed something interesting out to me, This is not a rash, it is a burn, but if this were a rash, it would have spread beyond the lines of the straps by now, so far, the only skin affected by this "reaction" is exactly where the straps were. A rash simply does not behave this way. Thank You Holly, I am for some reason having a hard time getting people's attention to the fact that it is not a rash, you worded it perfectly.

Now Holly and I are NOT doctors, but It is my opinion something is UP with these flip flops!

So what, I am supposed to call China?? Because the product that Walmart sold me burnt or hurt my feet?!

Ya know, It is my opinion Walmart has the responsibility to their consumers to sell stuff that, albeit cheep, is SAFE to their consumers, but it almost looks like passing the buck.

But ya know, one could argue, at what point is Walmart negligent? I think we have already crossed that line....

I absolutely can not believe it, they never even checked into it.....I thought I would go in since I can kind of walk now, but honestly,

I thought these shoes would not still be on the shelves. WHY are they still on the shelves when they can't be sure they are safe??

Hey! I decided to do an experiment, lets see if I am allergic to latex! Just for fun by the way. July 22nd

I have worn this latex glove for and hour and a half so far,(last night) I am wearing it for another hour then a will post a picture of any reactions I may or may not have.

Hey guys, it has been an hour, I decided to wear latex gloves on BOTH hands just for fun, but nothing is happening...

I am going to wear them for another hour or so.

I was told to give them equal time to the shoes I wore them for nearly 7 hours,

I have no reaction so far, but I will see if any develops tomorrow..

There are various theories circulating today regarding Beethoven’s health and hearing loss. It has been suggested that Beethoven was suffering from Syphilis (now discredited) or that he was poisoned. I have listed the presently accepted causes of his ailments and death, though tests are being carried out on his hair and should prove the matter conclusively.

Further test results on the Guavera lock of Beethoven’s hair have been published - I quote ‘The second test was a trace metals analysis conducted by Dr. William Walsh at the HRI & Pfeiffer Research Center in Naperville, Illinois. This test will reveal the presence of any trace heavy metals. The following results of this test were announced by Dr. Walsh on Tuesday, October 17th 2000:

High lead concentrations in Beethoven’s hair were found in independent analyses by McCrone Research Institute & Argonne National Laboratory. This is evidence that Beethoven had plumbism (lead poisoning) which may have caused his life-long illnesses, impacted his personality, and possibly contributed to his death. Distinctive trace-metal patterns associated with genius, irritability, glucose disorders, and malabsorption were not present in the Beethoven samples tested by McCrone Research Institute. Very low (undetectable) mercury levels were reported independently by McCrone Research Institute and Argonne National Laboratory. These results provide no evidence that Beethoven received medical treatment for syphilis, usually treated in the 1820’s with mercury compounds. This supports the consensus of Beethoven scholars who believe that Beethoven never had syphilis. Rumors that Beethoven suffered from syphilis have been discounted in all serious musicological literature for the last thirty years.’

DEAFNESS

The cause of Beethoven’s deafness is generally thought to have been Otosclerosis - the abnormal growth of bone of the inner ear. This bone prevents structures within the ear from working properly and causes hearing loss. Otosclerosis is a disease, which results in new bone formation either in the area of the stapes bone or in the cochlea housing the hearing nerve; or it can be a combination of both. When the bony deposits infiltrate the stapes bone, this bone is unable to vibrate and pass the sound into the inner ear. This results in what is called a conductive hearing loss, i.e., the sound is not being properly “conducted” into the inner ear. As a general rule, the thicker the bony deposit the greater the hearing loss, and the longer the hearing loss, the greater is the amount of deposits. The fixation of the stapes usually follows a slow and relentless course with progressively worsening hearing.

1826-7: Final Illness; Chirohsis/dropsy. (5 operations to drain fluid)

1947 – Emerson Romero develops the first captioning of a film by putting captions between picture frames.

1948 – Captioned Films for the Deaf (CFD) organized. First open-captioned film, America the Beautiful, produced.

1959 – CFD begins acquiring and captioning educational films.

1968 – CFD writes its first lesson guide for open captioned educational films.

1971 – The Caption Center was established at WGBH, a PBS affiliate in Boston.

1982 – Tripod Captioned Films (the original source for open-captioned film prints) was established. Tripod Captioned Films, an outreach program of the Tripod Education Program, was created to bring the big screen experience to deaf and hard of hearing movie going audiences. Tripod screened an open captioned version of The Big Chill at a Hollywood premiere.

1984 – CFD introduces their open-captioned videocassettes and becomes Captioned Films and Videos (CFV).

1988 – The Caption Center establishes Consumer Affairs Department to education deaf and hard of hearing viewers how to advocate for more [television] captioning.

1990 – Passage of the Americans with Disabilities Act (ADA).

Section 301(7)(C) defines “a motion picture house, theater, concert hall, stadium, or other place of exhibition or entertainment” as a “public accommodation.”

Section 302(b)(2)(a) says that discrimination includes:

(iii) a failure to take such steps as may be necessary to ensure that no individual with a disability is excluded, denied services, segregated or otherwise treated differently than other individuals because of the absence of auxiliary aids and services, unless the entity can demonstrate that taking such steps would fundamentally alter the nature of the good, service, facility, privilege, advantage, or accommodation being offered or would result in an undue burden . . ..

1991 – US Department of Justice issues ADA regulations for Title III (public accommodations).

Section 36.306(b) includes “open and closed captioning” as examples of “auxiliary aids or services.” However, the guidance for the regulations (the “Section-by-Section Analysis and Response to Comments,” published as Appendix B to the regulations) includes the following statement:

Movie theaters are not required by Sec.36.303 to present open-captioned films. However, other public accommodations that impart verbal information through soundtracks on films, video tapes, or slide shows are required to make such information accessible to persons with hearing impairments. Captioning is one means to make the information accessible to individuals with disabilities.

1991 – The Caption Center establishes the Media Access Research and Development Office, a pioneering facility dedicated to examining the needs and desires of underserved viewing audiences.

1993 – The National Center for Accessible Media (NCAM) is formed as the research arm of the Corporation for Public Broadcasting and WGBH-TV.

Tripod Captioned Films begins captioning feature films for special open-captioned movie screenings in theaters. Tripod relied mostly on open-captioned film prints donated by movie studios and arranged with local non-profit organizations to rent theater space. Between 1993 and 1997 the total number of films donated to Tripod was 25, with three to five open-captioned prints per title.

1996 – Movie Access Coalition, a subcommittee of the National Association of the Deaf (NAD) was established. Movie Access Coalition developed a White Paper on the need for vastly increased captioning of first-run movies in theaters. The White Paper included a proposed schedule to make all movies available with captions within three years.

1997 – At a January 1997 meeting in California of representatives from the Movie Access Coalition, motion picture studios, National Association of Theater Owners (NATO), and Tripod Captioned Films, the studios agreed to increase the number of open captioned movies. In July, A Simple Wish, produced by Universal Pictures, was shown at Cineplex Odeon Theaters in four cities – New York, Chicago, Los Angeles and Washington, DC. This was the first time an open captioned first-run movie was booked from a major studio directly to theaters via regular distribution channels, without any intermediaries or nonprofit organizations involved in the process.

Rear Window® Caption (RWC) display system debuted in California. The Jackel and the Titanic movies were shown with RWC captions.

1998 – Direct-studio distribution of open-captioned movie prints began. Since 1998, about 300 films have been produced with open captions and the number of prints per title has increased.

CFV changes its name to Captioned Media Program (CMP).

1999 – The Caption Center at WGBH closed captioned five movies for 10 RWC equipped theaters.

MultiMedia Designs, Inc., develop captioning glasses in which captions appear on a screen inside the lens of one eye.

2000 – Movie Access Coalition renamed the Coalition for Movie Captioning (CMC). CMC is a consortium of the major national organizations that addresses the theater access needs of 28 million deaf, hard of hearing, late-deafened and deaf-blind consumers. CMC’s goal is to make all first-run movies available to people with hearing loss. CMC charter member organizations were:

2001 – CMC adopted a “Position Paper and Statement of Expectations: Access for Moviegoers who are Deaf, Hard of Hearing or Late-Deafened” outlining its expectations for movie captioning in America. The CMC demands that captions (closed or open) must be available on the day and date of release of new movies. It is not enough to just have captions; the movie theatres must also follow certain professional standards for readability, such as appropriate color, font, size, and background.

Connecticut legislation introduced – General Assembly Bill 6929, An Act Ensuring the Availability of Captioned Movies to Persons Who are Deaf and Hard of Hearing. Legislation did not pass.

DTS Cinema Subtitling System (DTS-CSS) demonstrated with pilot showing of Pearl Harbor at TDI Conference.

2002 – CMC Theater Watch – Memorial Day Weekend:

34,490 indoor movie screens in the U.S.

5 to 14 screens showing open-captioned movies.

14 to 15 screens showing movies with RWC captions.

30 states with 0 screens showing a captioned movie.

InSight Cinema, a non-profit open-captioned film distribution company, was formed to carry the mission of Tripod Captioned Films forward. Films are distributed to over 50 major cities, and subsequently “bicycled” to nearby, smaller cities.

Texas Case – Complaint filed; case against motion picture defendants dismissed in 2003; and case against movie theater operators dismissed in 2004 (see below).

48 InSight Cinema open-captioned movies were produced; and 39 movies were captioned for display with RWC systems.

2003 – Movies begin to be produced with captions that can be projected on the screen in movie theaters with DTS-CSS caption display systems.

40 InSight Cinema open-captioned movies were produced; 66 movies were captioned for display with RWC systems; and 16 movies were captioned for display with DTS-CSS systems.

2004 – CMC supported federal legislation creating an incentive for movie studios and theaters to caption movies and install movie captioning technology by providing a substantial tax break. The movie captioning amendment, proposed by Senator Mark Dayton of Minnesota, was included in the Senate JOBS Act, which passed the Senate. Senator Dayton’s amendment would give a tax credit of 50% to both movie studios and theaters for making captioned movies available. Unfortunately, the amendment was not included when the House of Representatives passed its version of the bill.

New Jersey – Action taken by Attorney General resulted in agreements with 4 movie theater chains in 2004 and a lawsuit against Regal Cinemas that was settled in 2006 (see below).

New York – Action by Attorney General resulted in agreements with 8 movie theater chains in 2005 (see below).

____ InSight Cinema open-captioned movies were produced; 81 movies were captioned for display with RWC systems; and 78 movies were captioned for display with DTS-CSS systems.

About 190 RWC caption display systems installed; and 50 DTS-CSS caption projection systems installed.

2006 – Regal Cinemas, the largest theater chain in the country, recognizes and acknowledges the preference for screen-based (on-screen) captions and is committed to providing movie captions through Insight Cinema and DTS-CSS systems. Most Regal theaters with DTS-CSS systems will display captions one time every day during the day (a matinee); one time during the evening Sunday through Thursday; and sometimes (for popular movies being shown on multiple screens) one time during the evening on Friday and Saturday.

By the end of 2006, it is expected that there will be about 360 RWC caption display systems installed, and 210 DTS-CSS caption projection systems installed.

Captioned Movie Access Advocacy – Cases

Oregon Case –

Cornilles v. Regal Cinemas, Inc., 2002 WL 31469787 (D.Or.). Case against Regal, Century, Carmike, and Cinemark theater chains.

2000 – Complaint filed.

2001 – Coalition for Movie Captioning (CMC) filed amicus curiae (friend of the court) brief.

2002 – Case dismissed.

“. . . defendants need not install Rear Window Captioning Systems in all of their movie theatres to comply with Title III of the ADA. . . . anticipated costs of $6 million to $36 million per defendant is unreasonable as a matter of law.”

Texas Case –

Todd v. American Multi-Cinema, Inc., 222 F.R.D. 118 (2003 S.D.Tex.) and 2004 WL 1764686 (S.D.Tex.). Case against (1) “movie theater operators” – AMC, Cinemark, Regal, and Century; and (2) “motion picture defendants” – MGM, 20th Century Fox, Paramount, Warner Bros., Sony Pictures, Universal City Studios, Miramax, and Buena Vista.

2002 – Complaint filed.

2003 – Case against motion picture defendants dismissed.

2004 – Case against movie theater operators dismissed.

“The plaintiff has failed to refute the defendants’ evidence that the remedies sought here would not constitute an undue burden under the ADA.” “Equal access does not mean equal enjoyment. . . . Although section 36.303 [of the ADA regulations] includes in its definition of ‘auxiliary aids and services’ open and closed captioning, the plaintiff has not offered any or significant rebuttal evidence that precludes summary disposition of this case on the basis that access has been granted as a matter of law.”

DC Case –

Ball v. AMC Entertainment, Inc., 246 F. Supp. 2d 17 (2003 D.D.C.) and 315 F. Supp. 2d 120 (2004 D.D.C.). Case filed against AMC and Loews Cineplex Entertainment Corporation; class action for deaf or hard of hearing people in the Washington DC metropolitan area.

2000 – Complaint filed.

2001 – Court certified matter as a class action.

2002 – Defendants moved for summary judgment, to dismiss the case.

2002 – CMC filed amicus curiae (friend of the court) brief.

2003 – Court denied defendants’ motion for summary judgment.

Summary: (1) requiring exhibition of closed captioned films was not explicitly excluded from ADA; (2) rear window captioning (RWC) was auxiliary aid or service that could be required as a reasonable accommodation; (3) exhibition of RWC films would not change nature or mix of services provided by defendants; and (4) fact questions existed regarding degree of burden that requiring installation of RWC would impose on defendants.

2003 – Plaintiffs and defendants requested the Court to approve a proposed settlement.

2004 – Court preliminarily approved the Proposed Settlement Agreement and held a Fairness Hearing. CMC, DHHCAN, NAD and others participated in the Fairness Hearing.

2004 – Court approved the settlement.

Result – Added RWC caption display systems to 6 AMC and 6 Loews theaters (50% of existing AMC and Loews theaters in the Washington DC area); about 5% of their screens would be equipped to show captions.

New Jersey –

2004 – The Attorney General (AG) learned about lack of movie access at disability law conferences held in the spring. In August, CMC learned the AG was taking action; with possible lawsuits against movie theater chains. CMC sent a letter to the AG and met with AG representatives, but it was too late. In September, the AG announced agreements (consent orders) with 4 theater chains.

Result – 4 theater chains (AMC, Clearview, Loews, and National Amusements) with 35 theaters in New Jersey, about 383 screens, will have 39 RWC systems (about 10% of screens).

2004 – In September, the AG announced filing a New Jersey Law Against Discrimination lawsuit against Regal.

2005 – In February, CMC, NJAD, and Ms. Rainone requested the Court’s permission to participate in the lawsuit. The AG opposed the request; Regal did not. In March, Regal filed its Answer to the lawsuit, announcing its plan to install DTS-CSS caption display equipment and show movies with captions at least 12 times a week. In April, CMC, NJAD, and Ms. Rainone withdrew their request to participate in the lawsuit.

2006 – In March, the AG settled the lawsuit against Regal.

Result – Regal will show movies with DTS-CSS captions at least 8 times a week in 10 of its 12 movie theaters in New Jersey.

New York –

2004 – In September, the New York AG’s office contacted the NAD and inquired about captioned movies. NAD provided information and contacts for many New York deaf and hard of hearing associations.

2005 – In December, the AG announced agreements with 8 movie theater chains.

Result – Agreements made with 8 theater chains in New York with about 129 theaters and 1,132 screens. New York will have 38 theaters/screens with some caption access:

20 RWC systems, 9 DTS-CSS systems, and 9 locations with Insight Cinema showings. This represents about 30% of these 129 theaters and about 3% of their 1,132 screens.

Theater chains with RWC systems (AMC, Carmike, Clearview, Loews, and National Amusements) must monitor and report to the AG about RWC use for several years. The AG may negotiate with those theater chains to add more caption display systems if the AG thinks more are needed. This suggests that some significant number of people need to attend and use RWC at the one movie shown with captions at these theaters to indicate a need for access to other movies or a choice of movies.

Connecticut –

2005 – In September, the Connecticut Association of the Deaf filed complaints with the Connecticut Human Rights Office against 30 movie theaters. Complaints against 3 more movie theaters were later filed.

First Electric Hearing Aid - Some claim that Alexander Graham Bell’s telephone, developed in 1876, was conceived as an electric hearing aid for his mother. The first electric hearing aid may have been the Akoulathon, designed in 1898 by Miller Reese Hutchinson of the Akouphone Company in Alabama. The carbon transmitter was enlisted for uses such as the telephone and the electric hearing aid, which became commercially available in 1898. Hearing aids make sounds louder, either by mechanically funneling sound to the ear more directly or by electronic magnification. The first amplified hearing devices contained a battery-operated carbon transmitter and earphones. In 1898, the Akouphone Company marketed a carbon table model hearing aid that sold for $400. The carbon-type hearing aids gave amplification near the low end and the middle speech frequency range. The carbon transmitter was replaced by the vacuum tube in the 1920’s, and later produced the first transistor-based hearing aid. Smaller, more powerful and stable, all electric hearing aids used today are based on transistors.

His ancestors were partly Flemish (the Beethovens), partly German (the Keverichs). At first sight there is not the slightest trace of a proof for his “blackness”. We cannot exlude beyond any doubt that he had some drops “black’ blood in his veins. During the so-called 80 years war (1568-1648) Flanders and the southern part of the Netherlands were occpied by the spanish and a part of the Spanish army was ” Moorish”, as they called it in those days, which means from Northern Africa. So it’s not completely immpossible that one of those soldiers had been the cause of some African genes in the Beethoven family. What specifically is being referenced, is the true identity of Ludwig van Beethoven, considered Europe’s greatest classical music composer. Directly, Beethoven was a black man. Specifically, his mother was a Moor, that group of Muslim Africans who conquered parts of Europe–making Spain their capital–for some 800 years.
